These Terms of Service (the "Terms") are a binding agreement between you and Moev governing your use of the Moev mobile applications, website at moev.co, and the mobile EV charging services we provide (the "Service"). By creating an account, booking a session, or otherwise using the Service, you agree to these Terms.

Moev Emergency Roadside Service is not a substitute for calling 911 in a life-threatening emergency. If you are in immediate danger, call 911 first. Moev vans provide EV charging, not medical or safety response.

1. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use Moev. By using the Service you represent that you meet these requirements.

2. Your account

  • You are responsible for keeping your account credentials secure.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate, complete information and keep it up to date.
  • One account per person. You may not share your account or transfer it.

3. The service

Moev dispatches a mobile charging van to your specified address (or, for Emergency Roadside, to a location you provide) and delivers electricity to your EV. Service modes:

  • Scheduled — you pick a time window, we arrive within it.
  • Fleet — recurring service for multi-EV depots on an agreed schedule.
  • Emergency Roadside — on-call service to deliver enough charge to reach a fixed charger, subject to driver availability.

Availability, pricing, and service area are shown in the app at the time of booking. Prices are set from the Moev admin console and are subject to change; the price shown at booking is what you will be charged for that job.

4. Bookings, cancellations, and no-shows

  • Bookings are confirmed when you receive a confirmation via email or in-app notification.
  • You may cancel a scheduled booking at no charge up to 30 minutes before the driver is dispatched.
  • Cancellations after dispatch may incur a partial fee reflecting driver time already spent.
  • If you are not at the service address when the driver arrives, we will wait up to 15 minutes. After that, a no-show fee equal to the base session fee may apply.

5. Payment

  • Payment is charged automatically to the card on file when the charging session completes.
  • Payments are processed by Stripe. Your card details are stored by Stripe, not by Moev.
  • Receipts are emailed to your account email address.
  • Failed payments may result in temporary suspension of your account until resolved.

6. Refunds

If the driver is unable to complete the charging session due to a Moev fault (equipment failure, incorrect dispatch), you are entitled to a full refund. Refunds for session issues you report within 48 hours will be reviewed and processed within 5-10 business days to your original payment method.

7. Your responsibilities as a customer

  • Provide accurate location information and a safe, legal place to plug in.
  • Ensure your vehicle is accessible and unlocked / connector accessible at the scheduled time.
  • Do not obstruct or interfere with the driver's ability to complete the session.
  • Do not attempt to modify or bypass the charging equipment.

8. Drivers

Drivers are independent contractors approved by Moev. Additional terms in the Driver Agreement govern the driver relationship. Drivers must maintain a valid license, insurance, and satisfactory background verification.

9. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Harass, threaten, or endanger Moev drivers or staff.
  • Attempt to access other users' accounts.
  • Reverse-engineer, scrape, or otherwise abuse the Moev platform.
  • Provide false payment information or dispute legitimate charges.

Violation may result in immediate account suspension.

10. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied. Moev does not warrant that the Service will be uninterrupted, error-free, or available in your location at any given time. Moev makes no warranty regarding the specific range or performance your EV will achieve after a charging session; that depends on your vehicle, driving conditions, weather, and battery health.

11. Limitation of liability

To the maximum extent permitted by law, Moev's total liability arising out of or relating to the Service is limited to the total amount you paid to Moev in the six months preceding the event giving rise to the claim. Moev is not liable for indirect, incidental, special, or consequential damages.

12. Indemnification

You agree to indemnify and hold harmless Moev, its officers, employees, and drivers from any claims arising out of your misuse of the Service, violation of these Terms, or violation of applicable law.

13. Termination

You may close your account at any time via the app or by emailing info@moev.co. Moev may suspend or terminate your account for violation of these Terms, non-payment, or in response to legal or safety concerns.

14. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify you via email or in-app notice at least 30 days before the change takes effect. Continued use of the Service after the effective date means you accept the updated Terms.
